Patent Register in Indonesia Is Low

Patent Register in Indonesia is classified low. It occurs in not only public and industry but also collages. In fact, this patent is necessary to protect Hak Kekayaan Intelektual (HKI) or Intellectual Property Rights (IPR) and the ones having creativities from any harm.

It was stated by a patent examiner of Directorate-General of HKI Kemekum HAM, Dr. Ir. Robinson Sinaga, SH., LL.M. as the speaker of a workshop of Penyusunan Paten Drafting dan Lisensi HKI (Organizing Paten Drafting and License of IPR) at UMY, Saturday morning (1/11).

Robinson argued that Indonesian had not utilized yet facilities provided by government dealing with IPR register. He added that applicants of patent register in Indonesia were dominated by applicants from abroad. “It is not fully functioned in Indonesia. The statistic of applicants is still governed from overseas,” told Robinson.

He added that registering IPR was very essential in order that one’s ideas were not signed up by others. If an idea or discovery had already enlisted, the others could not freely make it since the law would consider that the applicant became the owner of IPR and it would be automatically saved.

“Patens are not given to the one who creates first, but the one who apply for paten register. Thus, if you are willing to be protected, register your paten. If you have already registered, who will use that have to get permission. It is extremely significant to save our creativities and have law from plagiarists,” he said.

The low register can be noticed from data of Directorate-General of HKI Kemekum HAM stating that in 2013 the highest paten register university could only sign up about 60 creations.

Seeing the fact, the director of IPR center of UMY, Dr. Mukti Fajar ND, said that it was too far compared to developed counties such as United States of America which the universities could register thousands of patents. Moreover, the universities had already employed registered IPR to earn money. “In abroad, it could be a source of income,” he added.

Mukti conveyed that UMY was eager to enhance the number of registered creations. UMY could sign up only 12 patents in 2013. This university had a target to register up to 50 creations of UMY’s academicians.

He considered that it was very significant to register patents of discoveries because many academicians had very great inventions. Academicians were demanded to overcome problems in society by implementing what they had learnt at the collage so that it would not be just theories.

“Many students have wonderful innovations. If those are not signed up soon, other people might have already registered similar ideas. Therefore, we could not use that and take advantages from what we found, or we might get involved in law,” he told. (Fahmy)
